Quick Answer
If your Punjab property is occupied while you live abroad, you can file a petition in the Special Court for Overseas Pakistani Property in the district where the property sits. On request, the court must arrange for you to take part by video link. You can also lodge a complaint on the OPC Punjab portal.

Your cousin has looked after your house in Lahore for six years. Lately he has stopped answering calls. Then a neighbour sends you a photo: a new nameplate on your gate, and it is not your name.
When you live in the UK, Dubai, Toronto or Riyadh, a moment like that feels hopeless. You cannot walk over and knock. You cannot take six weeks off for hearings. Punjab has built a few tools for exactly this situation, and most owners abroad never hear about all of them.
This guide explains the three routes available, how to take part from overseas, why your power of attorney matters more than anything else you sign, and the deadlines you cannot afford to miss.
Who This Guide Is For, and When You Actually Need a Lawyer
Not every worry needs a court case. Here is a rough way to sort your situation.
- A caretaker or relative is slow, evasive or has stopped paying rent. Start by gathering documents and, if useful, file an OPC complaint. Write down dates now, while the details are fresh.
- Someone claims to own the property, has changed the locks, or says it was sold. This is where a lawyer and a court petition come in, whether in the Special Court or the Property Tribunal.
- A dispute with siblings or co-heirs over your share. After the Lahore High Court's 2026 ruling, inheritance and partition disputes involving an overseas Pakistani may belong in the Special Court. Ask your lawyer.
If you are not sure which of these applies, an early consultation is safer than a wrongly framed first filing.
Three Doors, One Problem
Owners abroad usually have more than one forum open to them. They do different jobs, and mixing them up is the most common early mistake.
| Route | What it is | Best for |
|---|---|---|
| Special Court for Overseas Pakistani Property | A court under the Punjab Establishment of Special Courts (Overseas Pakistanis Property) Act 2025 | Property disputes involving an overseas Pakistani: possession, ownership, inheritance, partition, cancelled transactions and powers of attorney (scope widened by the Lahore High Court in 2026) |
| Punjab Property Tribunal | A district tribunal under the Protection of Ownership of Immovable Property law | Property taken through fraud, forgery or force, open to owners generally |
| OPC Punjab complaint | An administrative complaint to the Overseas Pakistanis Commission | Getting local police and revenue offices to act; it is not a court order |
These can overlap for the same property. Ask a lawyer which one should lead before you file anything, because contradictory filings in different places can hurt you.
What the Special Courts Are Built to Do
The Act was passed in January 2025. It lets the government establish special courts, in consultation with the Chief Justice of the Lahore High Court, to hear petitions filed by overseas Pakistanis about their immovable property.
In November 2025, the Punjab government approved the courts. A notification from the Services and General Administration Department designated district and additional district and sessions judges as special court judges across all districts. Cases about illegal possession, fraudulent transfers and obstruction of an owner's lawful claims are the kind these courts are meant to hear.
Who counts as an "overseas Pakistani"? The Act has its own definition. One law-firm summary describes it as a holder of a Pakistani passport, CNIC, NICOP, Pakistan Origin Card or OPF card who lives, works or studies abroad for more than 182 days in a tax year. Confirm the exact wording with your lawyer, and keep your documents and proof of residence abroad ready.
The Lahore High Court Widened Their Scope in 2026
At first, some special courts sent cases about specific performance, cancelled transactions or inheritance back to the civil courts, saying they fell outside the Act. In May 2026 the Lahore High Court disagreed.
It held that the special courts can hear the whole range of disputes connected to immovable property involving an overseas Pakistani. That covers ownership and possession, but also specific performance, partition, inheritance, the validity of transactions and related matters. One of the petitions in that decision concerned cancelling a general power of attorney.
Two more points from the judgment matter. Jurisdiction depends on a party's status as an overseas Pakistani, whether that person is the plaintiff or the defendant. And the court described the Act as an exclusive regime that takes these matters away from civil courts, directing that pending cases be transferred to the special courts and continue from the stage they had reached.
In practice, a dispute that once would have gone to an ordinary civil court may now belong in the special court. Ask your lawyer whether the judgment has been appealed or refined since.
Final Orders Are Protected
In a decision announced in July 2026 (Javed Masih v. Amar Javed, decided on 24 June 2026), the Lahore High Court held that a party cannot defeat the execution of a special court's final orders by later obtaining an ex parte decree from a civil court. It called repeated proceedings aimed at frustrating execution an abuse of process.
The same case noted that when several proceedings over one property were pending in different forums, moving the matter to the special court was proper, so that it could be decided consistently. The court also described the Act as a comprehensive framework for speedy disposal of overseas Pakistanis' property disputes.
That decision refers to the Pakistan Overseas Pakistanis Property Act, 2024, while the Punjab courts were set up under the Punjab Act of 2025. Ask your lawyer how the two relate and which one governs the court hearing your case.
Where Is the Property?
Special Court judges are designated in districts across Punjab, and the court that hears your case is normally the one with jurisdiction over the district where the property sits. Your lawyer will confirm the right court.
This matters when you hire. Ask any lawyer whether they appear in that district themselves or instruct a local advocate, and who you would deal with day to day.
Taking Part From Abroad
This is the part that matters most if you cannot travel. The Punjab Act says that, on the request of an overseas Pakistani litigant, the special court shall arrange for the litigant to take part in the proceedings through video link.
What the law promises and what a court registry does on a Tuesday morning can differ, so ask your lawyer three practical questions: can the petition be filed through an attorney, is e-filing available, and how will the video link be set up for your time zone? Islamabad's federal law, for comparison, speaks of evidence by video link supervised by officials of Pakistan's missions abroad. Check how Punjab handles it in practice.
Your Power of Attorney Is the Document That Makes or Breaks the Case
If you cannot attend, someone in Pakistan acts for you. That someone holds a power of attorney, and this is exactly where many overseas owners get hurt: the same paper that lets a lawyer file your case can let a relative sell your property.
How a POA from abroad is made valid
- Draft it (a lawyer in Pakistan can prepare the text) and sign it in front of a consular officer, or use the digital POA service offered through NADRA and the Ministry of Foreign Affairs.
- Get it attested by the Pakistani embassy or consulate in your country. Some missions ask for two Pakistani witnesses with CNIC details and passport photographs, so read your mission's checklist.
- In Pakistan, the Ministry of Foreign Affairs verifies it. Its guidance says a power of attorney from abroad stays valid for 120 days from mission attestation and ministry re-verification, so do not let the paper sit.
- Since March 2023 Pakistan is a party to the Apostille Convention. In some countries an apostille may be accepted instead of embassy attestation. Confirm with the receiving office which one applies to a court POA.
Keep it narrow
For a court case, use a special power of attorney limited to that case: engage a lawyer, file, sign, appear. Leave out the right to sell, transfer, gift or compromise. If a general POA is already out there, ask your lawyer about revoking it formally in writing through the same attested process.
Who holds your trust right now? Think about it honestly before you sign anything for anyone.
The OPC Complaint: Useful, But Know Its Limits
The Overseas Pakistanis Commission Punjab runs a complaint portal at opc.punjab.gov.pk and a 24/7 helpline at +92 42 111 672 672. You can lodge a complaint from anywhere in the world.
On receipt, the commission checks whether you are an overseas Pakistani as defined in the Punjab Overseas Pakistanis Commission Act 2014. Depending on the issue, it refers the matter to a government department or the District Overseas Pakistanis Committee, and the progress shows on the portal.
This route can nudge police and revenue offices into action. It does not give you a court decree, so treat it as support for a court case, not a replacement.
Build Your Evidence Pack Before You Call a Lawyer
- Registry or sale deed and the chain of transfers
- Latest fard and mutation record (a lawyer or trusted agent can obtain a certified copy)
- NICOP or POC, passport and proof of residence abroad
- Messages, voice notes and emails showing who was looking after the property, and when things changed
- Photos or video of the current state of the property, with dates
- Rent receipts, bank records or utility bills tied to the property
- Names and contact details of neighbours or other witnesses
What a Good Remote Engagement Looks Like
Hiring from abroad works best when the arrangement is explicit. Whoever you choose, look for these basics:
- A video consultation before you commit, not just WhatsApp messages
- A written engagement letter that states the scope, the fees and who handles your file
- A clear plan for the power of attorney, including its limits and expiry
- An agreed update schedule, for example after every hearing, with copies of orders
- A named person you can reach when you are awake and the lawyer is in court
- Receipts for every payment, and no cash handed to middlemen
These are signs of a lawyer who expects to be held accountable. They also protect you from the middleman problem described below.
A Sensible Order of Operations
- Secure your documents and record what you know.
- Shortlist two or three property lawyers and compare how they plan to keep you informed.
- Execute a narrow POA and get it attested before the clock on its validity starts to bite.
- Choose the lead forum with your lawyer, and file the OPC complaint alongside if useful.
- File the petition and ask the court to arrange your video-link participation.
- Keep copies of every order and set reminders for deadlines.
Deadlines You Cannot Miss
Under the Act's text, any person aggrieved by a judgment, decree or final order of the special court may appeal to the High Court within fifteen days. The High Court must decide the appeal within ninety days, appeals can also be filed against an ex parte decree, and a stay of execution granted in appeal lapses automatically after two months.
Fifteen days is short, especially across time zones. Ask your lawyer to diarise it the day an order is announced. Legal summaries also mention a 15-day step for leave to defend and a 90-day target for deciding the case, so ask your lawyer to confirm those from the Act as well.
Mistakes That Cost Overseas Owners Years
- Giving a general power of attorney to a relative "for convenience"
- Letting an informal caretaker arrangement run for years with no paperwork
- Waiting for the occupant to "come around" instead of acting early
- Filing in several forums with different versions of the story
- Paying a middleman who is not a lawyer to "fix it"
- Losing track of the date a POA was attested and having it expire mid-case
Frequently Asked Questions
Can I file a property case in Pakistan without travelling?
Often yes, through an attorney and, on request, by video-link participation. Exact practice depends on the court, so confirm with your lawyer before you rely on it.
Where do I file a Special Court petition?
In the Special Court that has jurisdiction over the property's district. The government designates judges across Punjab's districts, so your lawyer can confirm the right one.
Do I need to be a NICOP holder?
You need to qualify as an overseas Pakistani under the Act's definition. Keep your NICOP or POC, passport and proof of residence abroad ready, and check the definition with your lawyer.
What if my attorney is the one occupying my property?
Speak to a lawyer immediately about revoking the power of attorney and about the fraud or forgery route. A petition to cancel a general power of attorney was among the matters the Lahore High Court said special courts can hear. Keep every message and record.
Is the OPC complaint enough on its own?
Usually not. It is administrative support. A court order is what gives you an enforceable decision.
How long will the case take?
The law sets short deadlines, such as a 15-day appeal window and a 90-day High Court appeal decision, but the real timeline depends on notice, evidence and adjournments. Ask for a realistic estimate for your facts.
Can the other side beat my special court case by getting a civil court decree?
Not easily. In July 2026 the Lahore High Court held that a final special court order cannot be nullified by a later ex parte civil decree, and called such tactics an abuse of process. Ask your lawyer how this applies to your facts.
Can I use the Property Tribunal instead?
If property was taken by fraud, forgery or force, the tribunal may also be open to you. Your lawyer should decide which forum leads, so you do not undermine one case with another.
Conclusion
Living abroad does not mean you have to lose a property at home. Punjab now has special courts for overseas owners, a complaint portal that works from any time zone, and a video-link provision for people who cannot travel. What makes them work is preparation: a narrow power of attorney, clean documents, and a lawyer who keeps you updated.
Your next step this week: gather your registry, fard and passport copies, list who has been looking after the property, and book a consultation with a property lawyer. Ask which forum should lead in your case, and write the answer down.
